Who Gets the 21 November 2026 ITR Due Date
The extension is for the persons at serial number 2 of the table below Explanation 2 to Section 139(1). Broadly, that means:
- companies, where Section 92E does not apply
- persons whose accounts must be audited under the Income-tax Act or any other law
- working partners of firms whose accounts must be audited, and certain spouses of such partners
The return forms usually involved are ITR-3, ITR-5 and ITR-6, depending on the type of assessee.
Who Is Not Covered by the ITR Due Date of 21 November 2026
- Section 92E cases (international or specified domestic transactions requiring a transfer pricing report) keep their dates: audit report 31 October 2026 and return 30 November 2026.
- Salaried individuals and non-audit taxpayers. ITR-1 and ITR-2 were due on 31 July 2026 and non-audit business returns on 31 August 2026. If you have not filed, you can still file a belated return, generally up to 31 December 2026, with a late fee and interest.
- Anyone whose own due date was not extended. The circular is not a blanket extension for all taxpayers.
What Happens If You Miss 21 November 2026
| Consequence | Rule | Amount or effect |
|---|---|---|
| Late filing fee | Section 234F | ₹5,000, or ₹1,000 if total income is up to ₹5 lakh |
| Interest on unpaid tax | Section 234A | 1% per month or part of a month on the unpaid tax |
| Carry forward of losses | Sections 80 and 139(3) | Most business and capital losses cannot be carried forward if the return is filed after the due date |
| Belated return window | Section 139(4) | Generally until 31 December 2026 for AY 2026-27 |
| Audit report not filed on time | Section 271B | Penalty of 0.5% of turnover or gross receipts, up to ₹1.5 lakh, unless reasonable cause is shown |
What about interest under Section 234A?
The circular extends the filing date, but it does not expressly deal with Section 234A interest. Commentators read this differently, and earlier extensions have sometimes excluded interest. The safe course is to pay any self-assessment tax as early as you can, before you file, instead of waiting for 21 November. If you are unsure how interest applies to your case, check with your tax adviser.
Last-Two-Weeks Checklist Before Filing
- Audit report: confirm the Form 3CA or 3CB with Form 3CD has been uploaded and that you have approved it from your own e-filing account. The report date of 21 October 2026 has already passed, so do this first.
- Financials: finalise the balance sheet and profit and loss account, and make sure the schedules in the return match the audited figures.
- TDS and advance tax: reconcile TDS credits with Form 26AS and the AIS, and compute any balance tax due.
- Pay balance tax: deposit self-assessment tax by challan before filing.
- Losses and carry-forward: check brought-forward business and capital losses, so they are claimed correctly. They depend on filing by the due date.
- Digital signature: companies and many other audited assessees need a valid digital signature certificate to file. Check its validity now. See our digital signature certificate service if you need one.
- Verify: complete e-verification of the return promptly after filing. A return that is not verified is not treated as validly filed.
